REPOST: Baltimore Journalist Arrested For Questioning Official - The Beginning

The first post on this blog. My what a journey it's been. - Ed.



In a city riddled with allegations of government corruption, widespread incompetence, and an out of control crime problem, some police officers apparently have taken a novel approach to restoring peace and order to the slowly sinking ship that is Baltimore City; arrest law abiding citizens who aren't actually committing crimes. That way, when asked what is being done, they can point to numbers that don't tell the real story, then point out how many arrests have been made.

Remember how on the Titanic the musicians continued to play even as water filled the cabins and half the decks were already underwater? Well, in Baltimore the situation is similar. The truth is, things are far worse than anyone is willing to talk about, but meanwhile the masses live in a state of addled apathy.



“There are thousand of cases like this being thrown out every month,“In the month of February, we threw out 902 cases; in March, we threw out over 1,200 cases — that means 70 cases a day.” -- Margaret Burns, spokeswoman for the State’s Attorney’s Office


Baltimore Police have a history of locking folks up, just because. Sometimes merely asking a question of of an officer can land you in jail. Don't believe me, just check out this story from The Baltimore Examiner in 2006. In that story, a young couple, visiting from out of town was arrested for asking a cop for directions. Talk about rolling out the welcome mat. I wish I could tell you that this practice has stopped, but sadly, it is still going on, and apparently with a great degree of frequency.


"I Can Send Anyone To Prison Just Because I Don't Like Them"

Allow me to tell you the story of one James MacArthur. As 
a part time journalist with years of experience and a broad body of work in several fields, he is always on the lookout for story ideas. After learning his car was impounded and a trip to the Baltimore City impound lot would be necessary, he thought it would be a perfect chance for a story. After all this place is well known for lousy customer service.  Of course, what he didn't know was, asking questions of Baltimore public officials is a jailable offense.

Never mind the First Amendment or anything like that, no, this is Baltimore City remember? It's the impound lot. The same place that is under ongoing investigation for all kinds of criminal activity. This place has been abusing the people of Baltimore for years. Thieves, liars and rude are just a few of the words that can be used to describe some of the folks working there.

Customer Service, Charm City Style

On 29 December 2008, MacArthur went to the impound lot for the purpose of retrieving his car. He felt the car was wrongfully impounded, and decided to document his experience for a future story. In the parking lot, while sitting in a car, using a cell phone camera, MacArthur began narrating.

Continuing to film,he walked into the lobby and was immediately met with loud protests from impound lot staff telling him he was not allowed to tape inside. MacArthur advised them he was an investigative journalist, and he was simply doing a story on Baltimore City government customer service. A staff member asked him for his name and contact information. MacArthur complied, giving them his cell phone number, and then took a number from a wall mounted dispenser, to be placed in que for customer service.

Waiting for his number to be called, he said there were several patrons in the lobby, some of them quite vocally agitated by the experience of dealing with the place. He told them he was a reporter and if they wanted to talk to him and share their experience, he'd be glad to meet them outside.

Suddenly a man from behind the counter came out and angrily confronted him. Never identifing himself as management, or an employee for that matter, and standing merely inches from MacArthur, he asked if there was a problem. Not knowing who the individual was, MacArthur asked him if he could identify himself. The man walked away disappearing back into the office.

At this point, MacArthur said he was there for no more than 5 minutes when his phone rang. On the line was Adrienne Barnes, Director of Communications for the Department Of Transportation, which the lot falls under. According to MacArthur, Barnes asked what was going on, and who he was working for. He told her he was doing a piece on customer service. She then asked how much longer he would be there taping, to which he replied, 10 minutes or so. Barnes said that would be fine, but the employees were kind of nervous and in the future she would appreciate being contacted in advance. MacArthur then told her, that as an investigative journalist, he prefers to show up unannounced, after all, it was a public building.

While standing outside near the entrance, still on the phone with Barnes, four officers, one with a nightstick in his hand, marched past MacArthur and went inside. MacArthur ended the call with Barnes telling her the were police on scene. He then went back into the building at which point the officers immediately surrounded him. The lead officer, identified as Officer Michael Maurice, of the Baltimore Police asked him to step outside. MacArthur says he feared going outside with the four officers. Their aggressive posture and demeanor made him feel that he was in danger of bodily harm and therefore, would only be safe if he remained in view of other people.

Don't You Dare Question Me

Officer Maurice asked MacArthur a second time to step outside, to which MacArthur replied "why?" Maurice said he wanted to talk to him and there were too many people in the lobby for him to do so. MacArthur then suggested they could step to the side while remaining in the lobby to talk.

At that point, Officer Maurice handcuffed MacArthur and told him he was under arrest for disturbing the peace. It is interesting to note that on the charging the documents, the official charge is listed as trespassing. Trespassing in a public place no less.

While this sort of thing happens often in this city, it is not often we get to see video from a cell phone, of a journalist getting arrested simply for asking a question. This I suppose is the new strategy for fighting crime. Speaking about another incident Burns said “nuisance arrests” waste city resources that could be better used to fight violent crime.

Can anyone tell me where the life vests are? We're going down, and we're going down fast!

Troy Harris, spokesman for Baltimore City Police was contacted concerning this story, he declined to comment, stating that it is an open case and an ongoing investigation. Yeah, and I'm sure the investigation involves more police resources that could be better spent.

Cop Who Concealed Murder Weapon Will Not Be Criminally Charged

The twisted tale of what happened in the aftermath of the tragic "accidental shooting" of Monae Turnage has just turned into a strange trip. A trip to the increasingly bizarre world that is the Baltimore justice system. Despite the weapon used to kill the 13 year-old, being found hidden in the trunk of Baltimore Police Officer John Ward's car, we now know the State's Attorney punked out on charging him.

Apparently State's Attorney Gregg Bernstein was so fearful of looking woefully incompetent, that he kept the decision a secret for two months until Justin Fenton forced his hand. Next time he could at least tell the family of the victim the case was closed.


Where's Police Commissioner Batts?

Has anyone really seen the guy perform as commissioner yet? It would be nice to hear a bit more from him.

Considering his reputation for being frequently M.I.A. at his last job, I'm starting to wonder if his time here is NFL (not for long). "I have recognized that the conditions under which I was hired as chief have changed and do not allow me to fulfill the primary mission to provide an environment where one can live, work, play and thrive free from crime and the fear of crime," Batts said in his letter to Oakland residents.

Has there been an open press conference where he's taken questions from reporters? Between the latest news on the Monae Turnage case, the Anthony Anderson murder-by-cop catastrophe, and all the other mayhem and shenanigans he must be discovering within the Baltimore Police Department, could the Battsman possibly be already having second thoughts?

On this day in history in 1973, Vice President of the United States and former Maryland Governor Spiro T. Agnew resigned. A whole litany of crimes committed while governor, including extortion and bribery had finally caught up to him. We could only hope his example serves as a stark reminder for upwardly mobile, crooked and corrupt Maryland politicians, that sooner or later your sins catch up to you. Sometimes when it does, the embarrassment is on a far grander scale than the local media that worked tirelessly to protect and promote them.

This week has been so bloody and violent, the poor ole Baltimore Spectator has not been able to keep up. Help us out, tell us what we missed.

Two triple shootings in three days, including two teenagers.

On Monday, an 18-year-old man was shot in the back in the 1700 block of E. North Ave. around 9 a.m. Monday. He was driven from the shooting scene to Johns Hopkins Hospital.

A man found stabbed to death in his car today.

Yesterday a body was found in a vacant row house.

At this rate, you could practically trip and fall over the bodies on a walk from Towson to the inner harbor. Houston, we got a problem. I'm a afraid things may be too far gone, and the only solution might be a ticket to the moon.

Since the original writing, ANOTHER triple shooting.

Today (Friday) a young child was shot!

COP TALK!

The Baltimore Spectator spoke with veteran retired Baltimore Police Captain Jerry "Buz" Busnuk; here are his remarks;


Those numbers are only the ones the press has learned about; I wouldn't be surprised that there were a fair number of other violent acts, including robberies, that we generally don't know about. The city's website has about a 2-week lag in its postings. (For a while over the winter, they apparently weren't updating at all because a key employee had left).

I can tell you that while attending many community meetings in the past, as a sergeant in the Southwest, and a Captain in the Northwest, neighborhood people and leaders invariably worried about the coming of the first warm weather--and its attendant violence potential. There's a lot of street action when it gets to be above 65, a lot of hanging out, acting out and hollering and stuff. A lot more strutting and posturing outside, and drinking, and people pushing their limits with other people: till they find someone who doesn't like to be pushed.

Last weekend was pretty warm and one of my correspondents reported that there was a "pseudo-riot" at closing time at Iguana Cantina/Power Plant live area. That often happens at closing time in the heavy bar areas. [Sensible people head for home about 1am; people looking for excitement hang around to watch the fights and other action.]
It's like people feel they have to just bust out!

It sounds like these triple shootings were targeted as a result of either: a particular personal beef or, a continuation of the organized-crime connected killings related to Baltimore's own private civil war--covering about 4 square miles of the city. We don't have enough information at this time. I'm sure the Commish and his crew are concerned. The City Paper has done a lot of good reporting on the the violence to capture part of the city's lucrative drug markets, particularly the bizarre events surrounding the kidnapping of two brothers in Catonsville last year.

Oh, and usually Thursday night is when it starts getting busy for the weekend.

Third Triple Shooting Of The Week

4500 block of Marble Hall Road in the city's Northwood neighborhood

So BPD, what was that you were saying about non-fatal shootings going down?. The streets heard you, and they are intent of not allowing the title of BodyMore, Murderland to be lost.

Three men ages 19, 20 and 33 were all drinking in the Northwood neighborhood last night. A car pulled up and someone inside it fired several shots from a gun then the vehicle fled the scene. One man was shot in the hand, and the other two were struck in the leg and foot. Not much is known, which of course is typical for these incidents in this city.

Anyone with information is asked to call the district's detective unit at 410-396-2444.

Second Triple Shooting In Three Days


Three men were reported shot last night in the 2900 block of Greenmount Ave. Apparently the incident happened inside a fast food carryout. At this writing, the victims are reported to be injured but have so far survived the shootings.

Inquiries to the Baltimore Police Department have yielded few details. No motives or suspects have been revealed.

The shooting marks the second triple shooting in three days.

This journey begun after A.F. James MacArthur, now Managing Editor, was wrongfully arrested by the Baltimore Police Department while attempting to perform an investigative report. After contacting numerous local media outlets and having none interested in the story; university instructor and retired government scientist T.R. Mencken, decided to launch this blog and tell the story, along with many other stories the media does not want you to know.

On February 23 the case against MacArthur was dismissed. Currently Officer Michael Maurice is being investigated by internal affairs as a result of his actions in falsely arresting MacArthur.

BACK TO NORMAL: 4 Shot On Baltimore Street


After a mostly quiet week without any reported shootings or murders since last weekend, things seem to be getting back on track. Remember when I interviewed Police Commissioner Fred Bealefeld (see interview video) he said non-fatal shootings have decreased. Let's see how long that lasts. We're now at 36 murders versus 23 this time last year.

Every year, hundreds of people get shot and killed in Baltimore, hundreds more get shot, but manage to live. Either way you look at it, that's still a whole lot of people getting shot in Charm City.

Talk radio continues to reach the hearts and minds of the masses. Norris and Young morning radio shows discuss taxi meter decrease.


Although the mainstream did a poor job of covering the issue, talk radio is taking notice. This morning, both the Ed Norris Show, and the Larry Young Morning Show spoke on the issue of the taxi meter rate decrease. A.F. James MacArthur was an in studio guest on this mornings Larry Young Morning Show.

For an issue affecting the livelihood and jobs of a couple thousand people in Baltimore, you would think our local mainstream media would have given better coverage. No wonder so many people are turning to alternative "New Media" outlets such as The Baltimore Spectator to stay in their community.

Much like the politicians that are supposed to be representative of the people, the mainstream media have shown they have long forgotten their purpose for being, and continue to do a disservice to the citizens. So much time is given to questionable stories, but when you have an issue that hits right here in the community, you have the typical ignorance.

My conclusion. Politicians, along with the media are clearly arrogant and elitist and they feel they, and they alone, know what's best for the mere common folk.

Bodymore Murderland! -- ANOTHER ONE!

As a man who has been by Dodge City, who has walked the streets of old Tombstone, and even stood in the fabled OK Corral where the big shootout took place, I gotta say; those places ain't got nothing on Charm City. Our local little alternative daily reports another murdered body was found on the streets of Baltimore, on a sidewalk.

You gotta be careful around here, you literally never know when you might trip over a body. Think I'm kidding. The stories I could tell. Like the morning I awoke to the naked woman, laying dead in my backyard.



Sometimes We Get Lucky

Sometimes fate deals a good hand, and as a news man you end up being somewhere hours before anyone else. In this video, one of my most viewed news videos to date, I arrive first on scene, at what later became a pretty big story in Baltimore for the next few days.


BREAKING NEWS: Water Main Break Downtown from MacArthur Media

Potentially thousands of downtown Baltimore residents will be without water today. A major water main underneath the 100 block of E. Madison street ruptured causing a cascade of water to flood out several blocks of city streets.

Female Cop In Shooting, Overpowered, Lost Gun Before

Are Women Truly Capable Of Police Work?

Disturbing new details emerge about the Baltimore City Police officer,Traci McKissick involved in a fatal shooting last night. Records show she struggled and lost fights with male suspects in the past.

Four years ago, this week, after pulling over a vehicle, a struggle ensued with a male occupant. The man ended up wrestling the gun away from her and even firing a shot. It is seriously questionable as to whether this woman is capable of holding her own on the street.

I'm all for equality, but let's not push people incapable of doing the job just to say we're giving equal opportunity. Public safety is tough work, and not everyone, no matter their sex, is cut out for it. There is a young lady, a firefighter trainee, now dead, that would probably be alive today were it not for this kind of flawed, "progressive" thinking.

Whistler Blower: Examiner Publishers Visit The Spectator,Learn Of New Project

The Baltimore Spectator has learned that folks at The Anschutz Corporation, publishers of the now defunct Baltimore Examiner have visited this site. Apparently they were seeking to glean details on the upcoming project of Stephen Janis, senior investigative reporter of the Examiner. Janis told the Spectator he would be working with former Examiner reporter Luke Broadwater and editor Regina Holmes on a new website dedicated to focused, hard hitting investigative reporting on Baltimore City.
