Police Fail To Follow Own Policy On Cameras

A recent, highly publicized incident, involving the assault and harassment of a photographer at a crime scene by Baltimore Police, have thrust the issue of First Amendment rights into the public consciousness. 

Incidents of Baltimore Police violating the First Amendment rights of citizens are not new here. Truthfully there have been many well documented instances for years now. The beleaguered department seems to have a particular penchant for displaying a gross disregard for the rights of citizens.

It is notable that the only time the issue seems to get played up in the media, is when the victim of this abuse is someone other than a person of color. Put simply, when black people are being routinely harassed, threatened and intimidated by Baltimore Police, The Baltimore Sun, and nearly every other local media - who mostly only follow the lead of the Sun - make little if any mention of it, and quickly move on, implying a tacit approval of police misconduct going on under their watch.

That is, until it involves their own. Then and only then, is it a big deal, even spurring a public apology from Police Commissioner Anthony Batts, and the launching of an immediate investigation. If only the everyday citizens of Baltimore, daily dealing with abuse from overly- aggressive, poorly trained, heavy handed officers, could be so lucky.

Instead, having no voice, they typically suffer in silence, taking their place among the choice-less, with media ignoring the role of being a voice for the voiceless.

Addendum:

In November 2012, the Baltimore Police Department finalized and adopted a formal policy for dealing with photography and video. Despite being sent to every officer via email, discussed during roll call, and plenty of media mention initially, General Order J-16 has become in practice, nothing more than mere suggestions. Well written words of damage control.

Having absolutely no effect on officers behavior, with no punishment or discipline mechanism in place for violators, the rights of citizens in Baltimore continue to be crushed by the cops.

Baltimore Police General Order J-16: photo, video policy

Upon discovery that a bystander is observing, photographing, or video recording the conduct of police activity:

1. DO NOT impede or prevent the bystander's ability to continue doing so based solely on your discovery of his/her presence.

2. DO NOT seize or otherwise demand to take possession of any camera or video recording device the bystander may possess based solely on your discovery of his/her presence.

3. DO NOT demand to review, manipulate, or erase any images or video recording captured by the bystander based solely on your discovery of his/her presence.

4. For investigative purposes, be mindful of the potential that the bystander may witness, or capture images/video of events considered at some later time to be material evidence.

5. BEFORE taking any police action which would stop a bystander from observing, photographing, or video recording the conduct of police activity, Officer(s) must have observed the bystander committing some act [deemed criminal, such as obstruction, disorderly conduct or interfering with an officer's lawful duties].

Man Injured After Being Shot Multiple Times

After Seven Days Of No Reported Shootings, Violence Returns To Baltimore
Apparently death by stabbing doesn't count. During this same time period, 17-year-old Jowan Henry was stabbed and killed, after an argument Saturday night in the 2600 block of Mura St. The third juvenile murder victim this year.

A man was shot multiple times Sunday afternoon in the 2500 block of Druid Hill Ave in West Baltimore. Although unconfirmed, according to the first initial tweet breaking the incident, by Baltimore Metro News, the victim is said to be 28 years old.
The Baltimore Spectator spoke to relatives of the victim at the scene. They indicated the man was still alive, being treated at an area hospital and was expected to survive.


A Wake Up Call For All Of Us

Details on the shooting are unclear, but apparently the victim may have been shot inside a home. A woman living at the house, peered out the window and said she was asked by police to remain upstairs while they processed and investigated the first floor of the home as an active crime scene. A young boy could be clearly seen looking outside through the same window. It is presumable he was a witness to the incident.
Police officials and crime scene investigators were seen going in and out of the house. There were no evidence markers indicating the presence of shell casing or other items related to a shooting on the outside.

The surrounding neighborhood is no stranger to violence. Among the trash strewn alleyways and vacant home lined streets, numerous homicides have taken place within the immediate vicinity over the years.

Multiple faded balloons and other artifacts could be seen tied to poles and street signs, marking the places where other victims have lost their lives.

Incidentally, it was over an hour after the incident happened before Baltimore Police tweeted the shooting. In typical fashion, few details were given. No word of a possible suspect or motive.
File this under: routine, non-fatal Baltimore shooting. The kind of incident that will be lucky to literally get 15 seconds of TV time on the evening news. If any mention at all.

Police Blast Bad Guys With AND Without Guns - 3 Shot, 2 Dead

CORRECTION: Initial information indicated both suspects were shot and killed in the second incident involving police impersonators and a home burglary. At this point only one suspect is confirmed dead. The status, condition, and identification of the other man is still unknown. Baltimore Police have not provided the information. 3 February 2014

In most cities, two police involved shootings, just a couple hours apart would be major news. But in Baltimore, apparently we're easily impressed, so when it snows in winter, it's time to drop all real reporting, and pretend endless repetitive chatter about snow is insightful and informative.

Despite police clearly stating the robbery suspect at the 7-11 near Mondawmin on Liberty Rd did not have a gun, the fact that he was shot while posing no threat to safety, will likely be quickly overlooked and given a pass with the consent of the media.

After all, he was a criminal. This is Baltimore. Aren't we supposed to shoot them?

Meanwhile, in classic Baltimore Police fashion, everything came to a screeching halt once The Baltimore Spectator arrived on scene to cover the story. It is notable, no other journalists on location were harassed, intimidated, or threatened by Baltimore's gestapo, jackbooted thugs.

Agitator-In-Chief, James MacArthur, expressed his severe disappointment to Commissioner Batts in an open letter.


It would be nice to see more of the real police on our streets, the ones worthy of the title officer. The rest, best be gone. They continue to destroy all credibility and relationships with the community.

Despite the grossly inaccurate, cavalier downplaying and marginalizing by Baltimore Sun reporter Justin Fenton, of what was a very serious and unwarranted encroachment by police who should have been focused on investigating and incident, we remain undeterred..

As citizens and a journalists, there is no reason to sit quietly and take abuse from government official who are supposed to be serving us all.

A Crappy Ending... To A Life 

No one envisions their expired earthly body being discovered in a place where human waste is deposited.

Like the day before, Wednesday started with a first-thing-in-the-morning bonus body. What is a bonus body you ask? It's when a random dead body is found, and there's no immediate connection to a known or reported crime.

A mans body was found in a porta potty in the 900 block of Thames St. near Wolfe St. Wednesday morning in the Fells Point community.  Although we're told homicide detectives are investigating, there was no word on the circumstances or whether foul play was suspected. This being Baltimore, we're suspicious.

With over 30 murders, plus 4 police involved shootings this year, those homicide guys are really busy. Don't expect to hear much from them any time soon. After all, half of the murder happening here are never ever solved.

Perhaps dead bodies being found has become so routine (we've had three since last week), that's its no longer news here, but if you're looking for an article on this incident, good luck. There are none. Our initial searches indicate the Baltimore press corps has little interest in this one. For now. After all, it is winter, and it's snowing.

As we pointed out yesterday, when the day begins this way, lookout, it's a sure sign of oncoming chaos. And the day surely delivered.

BREAKING NEWS: White People Discover It's Dangerous In Baltimore

On the heels of all the hoopla created after certain parts of the city suddenly started standing up and speaking out on the epidemic of violence, a hugely attended community meeting on crime in the community was held in Southeast Baltimore.

Although crime has plagued this city for decades, and the police have never been real effective in dealing with it, it's now trendy to demand a more responsive and committed police force in the city.

Basically, the stuff that's been written about in these pages for the last five years is starting to catch on.

Highlights from the meeting:

Commissioner Batts: "Some of the things that are taking place in this community should not be happening."

For her part, Mayor Stephanie Rawlings-Blake said "I am focused … on action and finding partners who are doing more than complain." Translation, I really don't want to hear about your problems so save it.

Of course, nothing was said about things happening in other communities in the city.

Kudos to Del. Luke Clippinger, who organized the meeting and said the area's problems reflect broader issues in a city with a climbing homicide rate. We're glad the delegate is paying attention and showing concern, but shouldn't this meeting have been called by a city council member? Make them earn their keep!

Actions Must Speak Louder Than Words - Open Letter To Commissioner Batts

Dear Commissioner Batts,

Although I have very low hopes of your paying any attention to this, nor do I expect much to happen. I am a desperate man, with a desperate plea.

For far too long, I have been the subject of continued harassment, threats, intimidation, and even trumped up, false arrests (many of them thrown out) by members of the Baltimore Police Department.

As a long time, well known, independent voice in media, not to mention a taxpaying citizen of Baltimore, I'm utterly disgusted by officers on your force treating me like a second class citizen, and a criminal suspect. All because I have strong opinions and I'm not afraid to express them.

Perhaps they need to be reminded of what the First Amendment of the Constitution means for the citizens they serve.

Truth is, remedial training on the rights of citizens in general would probably go a long way towards achieving that whole, citizen-and-community-cooperation thing you and the Mayor so often speak off.

As a journalist, I would like to perform my duties of informing the public without being hampered or harassed by the police. I don't see mainstream media treated this way. Last I checked, the police do not have the right to decide who is media and who isn't.

In a city filled with violence and residents who are sick and tired of seeing what appears to be no hope or solution in sight, we all want to see our police officers focused on crime and keeping us safe. Time and effort spent harassing me does nothing to further those ends.

We should be working together to serve the citizens of this city in our respective roles. Thus far, this simply hasn't happened. The Baltimore Police have decided to wage war on me. It is not my intention to sit in silence and take it.

It would be nice to see this stop.

Deja Vu All Over Again - Treacherous Tuesday

Two Shootings, Minutes Apart, Two Days In A Row - Plus Bonus Mystery Body

Just when you thought the daily drum of chaos and carnage, and violence and mayhem In Baltimore couldn't get any stranger, it does.

When the day begins with a dead body found in a home with apparent head trauma,  and it's not even 7:30 a.m. yet, it's almost as if it's a harbinger of things to come.

Police aren't saying who found the body or how they learned of the incident. The victim's identity has not been released. As usual, there are no known motives or suspects.

Hours later we get this:


Less than 10 minutes later...

Capping off what was just another Tuesday in Baltimore, coming in an hour before the midnight cutoff there's this:


But Wait, Haven't We Seen This Before?

Monday night also saw two shootings. Not only were they minutes apart, but they seem to have taken place at nearly the same as Tuesday's shooting. Pay close attention to the dispatch times.

Also, on Wednesday night, be sure to be especially watchful of your back between 8:30 and 8:45 p.m. If these things happen in three's, two people are gonna get whacked right about that time.

Police have given no known motives nor suspects for any of these incidents. The man shot on Pennsylvania Avenue is now dead. The one shot on E. Eager street was actually a teenager shot in the face while having the audacity of walking to the store. He remains in critical condition.

But remember, once again we're told the Mayor and the Police Commissioner have a new plan. And it's gonna save us all.

Media Fail Pt. 1 -- Initial Reaction

Two people were shot Monday night in two separate incidents. Both happened within 15 minutes of each other.  One in East Baltimore, the other in West Baltimore.

The incident in East Baltimore involves a teenager shot in the head with injuries so severe, homicide detectives are investigating.

Coverage of these latest incident in Baltimore's continuing carnage was a disgrace on the nightly news.

From 15 seconds passing mention on one station, to no mention at all, it was made abundantly clear how unimportant these lives being lost in the city really are. They're not even worth talking about.

A message is being sent loud and clear to residents, especially youth, living in less than affluent neighborhoods. Whether you live or dies is inconsequential to us. You're of no value to society. Your stories isn't even worthy of being told.

In a special broadcast, I took to the air Monday night, doing my best to channel and control my rage to discuss the shameful, inexcusable marginalizing of the lives affected by the destruction taking place in Baltimore.

In part two of this series, we'll give a more detail breakdown of the precise amount of time given to the shootings by each of the local news outlets. These stories will continue to be tracked as we see how they develop within the news cycle.

REPOST: Baltimore Journalist Arrested For Questioning Official - The Beginning

The first post on this blog. My what a journey it's been. - Ed.



In a city riddled with allegations of government corruption, widespread incompetence, and an out of control crime problem, some police officers apparently have taken a novel approach to restoring peace and order to the slowly sinking ship that is Baltimore City; arrest law abiding citizens who aren't actually committing crimes. That way, when asked what is being done, they can point to numbers that don't tell the real story, then point out how many arrests have been made.

Remember how on the Titanic the musicians continued to play even as water filled the cabins and half the decks were already underwater? Well, in Baltimore the situation is similar. The truth is, things are far worse than anyone is willing to talk about, but meanwhile the masses live in a state of addled apathy.



“There are thousand of cases like this being thrown out every month,“In the month of February, we threw out 902 cases; in March, we threw out over 1,200 cases — that means 70 cases a day.” -- Margaret Burns, spokeswoman for the State’s Attorney’s Office


Baltimore Police have a history of locking folks up, just because. Sometimes merely asking a question of of an officer can land you in jail. Don't believe me, just check out this story from The Baltimore Examiner in 2006. In that story, a young couple, visiting from out of town was arrested for asking a cop for directions. Talk about rolling out the welcome mat. I wish I could tell you that this practice has stopped, but sadly, it is still going on, and apparently with a great degree of frequency.


"I Can Send Anyone To Prison Just Because I Don't Like Them"

Allow me to tell you the story of one James MacArthur. As 
a part time journalist with years of experience and a broad body of work in several fields, he is always on the lookout for story ideas. After learning his car was impounded and a trip to the Baltimore City impound lot would be necessary, he thought it would be a perfect chance for a story. After all this place is well known for lousy customer service.  Of course, what he didn't know was, asking questions of Baltimore public officials is a jailable offense.

Never mind the First Amendment or anything like that, no, this is Baltimore City remember? It's the impound lot. The same place that is under ongoing investigation for all kinds of criminal activity. This place has been abusing the people of Baltimore for years. Thieves, liars and rude are just a few of the words that can be used to describe some of the folks working there.

Customer Service, Charm City Style

On 29 December 2008, MacArthur went to the impound lot for the purpose of retrieving his car. He felt the car was wrongfully impounded, and decided to document his experience for a future story. In the parking lot, while sitting in a car, using a cell phone camera, MacArthur began narrating.

Continuing to film,he walked into the lobby and was immediately met with loud protests from impound lot staff telling him he was not allowed to tape inside. MacArthur advised them he was an investigative journalist, and he was simply doing a story on Baltimore City government customer service. A staff member asked him for his name and contact information. MacArthur complied, giving them his cell phone number, and then took a number from a wall mounted dispenser, to be placed in que for customer service.

Waiting for his number to be called, he said there were several patrons in the lobby, some of them quite vocally agitated by the experience of dealing with the place. He told them he was a reporter and if they wanted to talk to him and share their experience, he'd be glad to meet them outside.

Suddenly a man from behind the counter came out and angrily confronted him. Never identifing himself as management, or an employee for that matter, and standing merely inches from MacArthur, he asked if there was a problem. Not knowing who the individual was, MacArthur asked him if he could identify himself. The man walked away disappearing back into the office.

At this point, MacArthur said he was there for no more than 5 minutes when his phone rang. On the line was Adrienne Barnes, Director of Communications for the Department Of Transportation, which the lot falls under. According to MacArthur, Barnes asked what was going on, and who he was working for. He told her he was doing a piece on customer service. She then asked how much longer he would be there taping, to which he replied, 10 minutes or so. Barnes said that would be fine, but the employees were kind of nervous and in the future she would appreciate being contacted in advance. MacArthur then told her, that as an investigative journalist, he prefers to show up unannounced, after all, it was a public building.

While standing outside near the entrance, still on the phone with Barnes, four officers, one with a nightstick in his hand, marched past MacArthur and went inside. MacArthur ended the call with Barnes telling her the were police on scene. He then went back into the building at which point the officers immediately surrounded him. The lead officer, identified as Officer Michael Maurice, of the Baltimore Police asked him to step outside. MacArthur says he feared going outside with the four officers. Their aggressive posture and demeanor made him feel that he was in danger of bodily harm and therefore, would only be safe if he remained in view of other people.

Don't You Dare Question Me

Officer Maurice asked MacArthur a second time to step outside, to which MacArthur replied "why?" Maurice said he wanted to talk to him and there were too many people in the lobby for him to do so. MacArthur then suggested they could step to the side while remaining in the lobby to talk.

At that point, Officer Maurice handcuffed MacArthur and told him he was under arrest for disturbing the peace. It is interesting to note that on the charging the documents, the official charge is listed as trespassing. Trespassing in a public place no less.

While this sort of thing happens often in this city, it is not often we get to see video from a cell phone, of a journalist getting arrested simply for asking a question. This I suppose is the new strategy for fighting crime. Speaking about another incident Burns said “nuisance arrests” waste city resources that could be better used to fight violent crime.

Can anyone tell me where the life vests are? We're going down, and we're going down fast!

Troy Harris, spokesman for Baltimore City Police was contacted concerning this story, he declined to comment, stating that it is an open case and an ongoing investigation. Yeah, and I'm sure the investigation involves more police resources that could be better spent.

Monday Night Mayhem: 2 More Murders In Harm City

2 men killed in northwest Baltimore shootings Monday night

Two men were killed in shootings about two miles and a few hours apart in Northwest Baltimore Monday evening.

Around 7:48 p.m., a man was shot in the city's Greenspring neighborhood, in the 4400 block of Pall Mall Rd., police said. He was taken to an area hospital, where he was pronounced dead.

Around 4:30 p.m., another man was shot in a minivan a few miles away, in Forest Park, police said.


After driving off the road and crashing into a tree on West Forest Park Drive, the victim ran to a nearby field in the 3600 block of Liberty Heights Ave., in Ashburton, where he collapsed, police said. He was taken to an area hospital, where he later died.

Father And Son Killed In Double Shooting

A father and son were both killed in a double shooting that happened shortly after 3:00 p.m.Wednesday, on the 2900 block of Edmondson Ave., in the Edmondson Village neighborhood of Baltimore City.
The elder of the two victims is a man tentatively identified via social media as Frank Turner. His son Anthony Turner was with him when both were shot and killed on the sidewalk in a residential neighborhood.

The incident was witnessed and the story broken via twitter by local talk radio host Daren Muhammad, who happened to be driving past on Edmondson Ave.

This is a developing story. Check back for updates as more information becomes available.
